Copyright
Discussion in preparation for the meeting with Kevin Davis, to take place March 28. As led by Holling Smith-Borne, the group discussed various copyright questions and conundrums. Participants posited a variety of questions about copyright, the meeting of technology and copyright law, and University policy. Questions such as:
- Is it the role of the library staff to directly engage patrons who are suspected of activities that potentially violate copyright law? (e.g. a library DVD is checked out and the patron returns it while admitting that copies of the DVD had been made)
- Is it the role of library staff to make sure that materials posted in OAK have been cleared by the copyright office?
- Can the library accommodate streaming video (as a library service, and in addition to TVNews archvie), and do we have the proper bandwidth, storage, software, and support capacity?
- In order to accommodate streaming video, does the library have to purchase distribution rights?
- Does the University’s current computer use policy incorporate any information regarding copyright issues?
- Does the existence of a closed system like OAK obviate the need for obtaining permissions?
- Is the ARL brochure (which seems to indicate broad use is permitted in connection to an educational purpose) compatible with University policy?
- If there is a violation of copyright, and the violation occurred with library materials or with library equipment, who is liable? The library? The patron? The university?
- Are current policies and practices used for streaming audio sufficient for streaming video?
The group also discussed the current state of practice. Such as:
- Streaming audio is being used in Music only. Kevin Davis has reviewed the policy and there have been no comments or revisions as suggested by the Counsel’s office.
- No library is currently offering streaming video as a service (other than TV news archive). Music is particularly interested in offering this service.
- There is some anecdotal evidence that faculty post materials in OAK and do not obtain permissions before doing so.
- No library incorporates copyright training into instruction.
- If a library staff member is engaged in the course-building activity in OAK, then library staff will obtain permissions for materials posted in OAK.
There was some anxiety expressed in regards to the upcoming meeting with Kevin Davis. Although we would like answers to our questions, there was some concern that the answers would generate heartburn.
Vision for OAK
The OAK advisory board is meeting on Monday, March 19. Items to be discussed include software development and ongoing support, as well as the potential for a greater role for the library in supporting OAK.
Software Training
Peabody has observed additional demand for software training. Is there any room for greater coordination of training in order to accommodate the demand? There is some developing expertise for statistical packages (eg Sue Erickson), but should there be more? Demand for EndNote training seems to be a common denominator, and there was support to broaden the pool of trainers for this software package. There was some tepid support for OAK training, and it was unclear that a classroom setting is the best way to serve faculty eager to have assistance with OAK.
Owning library designation for Internet resources

Staff may contribute to library funds or to a particular library. It is not clear that gifts designated for a particular library, but processed by a central office, wend their way to the designated library.
